Terms
This agreement is entered into by and between Regina Mallory Photography, LLC, a Massachusetts Limited Liability Company ("Photographer") and the agent completing booking ("Client"), each a "Party"Â and collectively the "Parties."
Appointments for photographic services can be scheduled online. Please include all necessary information for booking such as lock box or gate code, approximate home size, number of rooms, any additional features or special requests.
SERVICES
Photographer will provide Client with the following services and/or products ("Services"): Professional photography of the Property for listing for sale or lease, high-resolution and low-resolution digital files and a commercial license of photograph use as outlined within this Agreement.
BOOKING AND PAYMENT
The Photographer and Client will agree on total price ("Total Fee") for these services. The Client will make payment either at the time of scheduling or on-site prior to delivery of photographs and media. Acceptable payment methods include cash, check, or credit cards. Returned checks are subject to a $25 returned check fee.
PROPERTY, PREPARATION, PETS, AND REQUESTS
It is important that the property is ready for the photoshoot at the scheduled time. Client will ensure the Property is ready for photographing prior to the scheduled shoot time. Photographer will not be responsible for any staging, cleaning, dusting, or moving of furniture. Client will ensure any pets are contained during the session, and no pets will be included in the photographs. Client will alert Photographer prior to the session if pets will be present in the Property during the session.
CANCELLATION, RESCHEDULE, AND LATE ARRIVAL
If the Client fails to show, provide appropriate access and materials, or cancels the day of the session, the entire Photographer's Total Fee is due immediately. In the event that the weather conditions are not desirable, the session will need to be rescheduled. In most cases, inclement weather can be worked around and still render a deliverable product. In the event of inclement weather, an alternate session for the exterior can be scheduled at a later time if need be. Due to liability and equipment damages, this decision will be at Photographer's sole discretion. Cancellations/rescheduling requires 24 hours advanced notice to avoid the Cancellation Fee of $75. Please contact the Photographer in the event of late arrival and we will do our best to accommodate, however please note that the time may be deducted from the total time allotted for the session.
COMPLETION AND DELIVERY
Photos will be uploaded to an online gallery as .jpeg files. Gallery will be completed within 24-48 hours. Rush delivery is available for an additional fee, typically delivered same day. Photographer may not retain archives on images for longer than one year. Payment is due upon booking and no materials will be released until the session fee is paid for in full.
PROPERTY AND TRAVEL
The photographic session will occur at the Property identified. Any travel fees are stated upon booking; if inquiring for a session outside of normal radius, additional fees may apply.
COMMERCIAL LICENSE TERMS
All photographic materials will be the exclusive intellectual property of the Photographer. The Photographer grants Client a license to reproduce, publicly display, and distribute the photographs for promotional and advertising purposes directly related to, and for the exclusive purpose of, listing the Property for sale or lease and for the Client's self-promotion. Unless otherwise specified, licensing of the photographs is limited to a term of either one (1) year from the date of execution of this Agreement, or Agreement will terminate automatically at the termination of Client's representation of the Property, whichever occurs first. Further use of photographs outside of the licensing term will require Photographer's written permission and additional fees. Client may not transfer or sell rights to the images. Copyright of the images is owned by the photographer with license granted to the Client for use stated above by the Client or Client's parent company. Third party use is strictly prohibited unless additional licenses are acquired from the Photographer.
